Conditions of Use - By using this website, you certify that you have read and reviewed this Agreement and that you agree to comply with its terms. If you do not want to be bound by the terms of this Agreement, you are advised to leave the website, or other related services. Misfitz only grants use and access of this website, its grid, and alternate services to those who have accepted its terms. Asset Sharing & Hyperlinking - Users are individually responsible for ensuring compliance with the laws and regulations pertaining to the use, distribution, and linking of content within their respective jurisdictions. Notwithstanding, it is expressly prohibited for users to upload, exchange, link to, or solicit any content that is in contravention of US federal law. Any engagement by the user with such prohibited content will result in the immediate termination of the user's account without notice or restitution, and may warrant notification to relevant law enforcement authorities. User Privacy - Users are prohibited from sharing, through uploading to other services or devices, any videos and/or photos of avatars, content, or any other personal representations of other users, without their explicit prior consent, including but not limited to consent via a personal, in-world, instant message, or a scripted device that ensures user privacy in the event that they do not agree. Sharing, through streaming to other services or devices, is not permitted except in the case of the MisFitz Discord server and private calls, so long as it respects the Discord Terms of Service, and in the case of the MisFitz Matrix server, access to which is subject to these Terms of Use. In the event that any such video and/or photo is shared, in any form, it must not make reference to or make use of the MisFitz Word, Logo or URL. In order to ensure the safety of our users, & the longevity of the service, we reserve the right to examine user inventory and/or in-world objects at any time & at our discretion. We are precluded from discussing or commenting on particular cases due to legal constraints. However, please be assured that any enforcement action against a user would only transpire following meticulous examination and deliberation. Our guidelines and regulations are instituted to safeguard our users, comply with our legal mandates, and promote the sustained operation of the grid. Suspected misuse of off-grid chat services can lead to punitive actions against your account, up to and including a ban. Publicly posting Encrypted Platform I.Ds (Keys) or contact information (including but not limited to Session, Matrix, Telegram, TorGuard, tox, etc.) will also result in punitive actions taken against your account. Engaging other users in sexual or sensitive activity without their consent (including but not limited to, animating their avatar without their knowledge or prior permission) is strictly prohibited and is a BANABLE offense. Age restriction - You must be at least 18 (eighteen) years of age before you can be considered for membership through a 3rd party active member’s invite link. By using Misfitz Grid, you warrant that you are at least 18 years of age. Misfitz assumes no responsibility for liabilities related to age misrepresentation, and will take immediate action to remove any User that we have reason to believe is under the age of 18. Intellectual property - You agree that all materials, products, and services provided by you are the property of the original creator, or other 3rd party license. You also agree that you will not reproduce or redistribute any intellectual property of any kind, including works of art, digital or otherwise, or other new trademark registrations you do not own without permission. Any of your intellectual property that you upload to Misfitz, or create within Misfitz, remains owned by you, with no exceptions. Please note, however, that any content which leaves our grid via the Hypergrid is no longer under our control, and we are not able to remove content from other grids. Whether you are acting on behalf of the content's owner or are the owner yourself, by uploading content to onto our servers, you are granting Misfitz permission to display, use, copy, transmit, and/or broadcast the content you upload and publish, as far as required for the normal operation, maintenance and administration of the service(s). For issues regarding intellectual property claims, you may file a DMCA complaint via email at misfitzgrid@gmail.com. We will comply with the DMCA and will honour legitimate content takedown requests, including removal of rezzed items and user inventory if required. User Accounts - You are responsible for maintaining the safety and security of your identifying information. You are also responsible for all activities that occur under your account or using your password. You are also responsible for complying with these terms and any applicable local and international laws. If you think there are any possible issues regarding the security of your account on the website, you must inform us immediately so that we may address it accordingly. Accounts may not be shared, given away or sold, without the express permission of the MisFitz administrators. We reserve all rights to terminate accounts, edit or remove content at our sole discretion, at any time, and without compensation of any kind. Alt User Accounts - Alt accounts (accounts with other names used solely by yourself) are permitted, but must be declared in the invite system. There is no requirement to declare your alt to other residents. Declaring an invite as an alt account when it is not, or failing to declare an alt account as such, may result in termination of both accounts. If you make an error during the invite process in this regard, please file a support ticket with the information. Telling us about the issue, before it is detected, will not result in further action. Termination - Misfitz reserves the right to terminate your access to the website, its grid, and alternate services without notice if, at its sole discretion, you violate any terms of this Agreement. Upon termination, all rights granted to you under this Agreement will cease immediately, and you must promptly discontinue all use of the services. Misfitz Grid's termination of use policy is in place to protect the grid and our users from malicious and illegal content. Any attempt to circumvent administrative decisions regarding suspension or banning including aiding banned or suspended users in accessing the grid will result in an automatic ban. Any attempt to access our grid via the Hypergrid when banned, will result in a ban of your hypergrid account, and a report being made to the origin grid. This is for all of our protection and the safety of our grid. Indemnification - You agree to indemnify Misfitz and its affiliates and hold Misfitz harmless against legal claims and demands arising from third-party claims due to your breach of this Agreement, your misuse of the Service, or your violation of any law or the rights of a third party. We reserve the right to select our own legal counsel. Governing Law - This Agreement shall be governed by and construed in accordance with the laws of the state of California, without regard to its conflict of law principles. Both parties agree to submit to the exclusive jurisdiction of the courts located within the state of California, for the resolution of any disputes arising out of or relating to this Agreement. Severability - If any provision of this Agreement is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed from the remainder of this Agreement, and the remaining provisions shall remain in full force and effect. Limitation on liability - Misfitz is not liable for any direct, indirect, consequential, or any other type of damages that may occur to you as a result of any misuse of our service. Misfitz reserves the right to edit, modify, and change this Agreement any time. We shall let our users know of these changes through electronic mail to the e-mail address that we have registered to their accounts, within 30 days. This Agreement is an understanding between Misfitz and the user, and this supersedes and replaces all prior agreements regarding the use of Misfitz and its services. |
